Public Hearing
M. Ellis called the Public Hearing to order at 7:30.

PZC2010 To void/renew Home Occupation by Special Permit approved October 3, 2006 for a construction office and showroom at 141 Luchon Road (Owner: Wayne Bellefleur P.H. 7/20/10 Dec. within 65 days after close of P.H.)

M. Ellis asked if anyone was present to speak for this application and no one was.  

The application was approved in 2006 with the following conditions: The 840 square feet of office space existing above the existing garage may be used for the construction business upon completion of the new home which will be in excess of 1680 square feet.  All signage to be approved by the commission.  Compliance with the zoning regulations shall be adhered to.  The trailer/mobile home shall be removed prior to a certificate of occupancy or occupancy for the new home.  Annually renewable.  

M. Ellis asked if Mr. Bellefleur was aware. S. Yorgensen said they have sent notices asking Mr. Bellefleur if he wanted to renew.  

M. Ellis asked if the trailer was still there. S. Yorgensen said the trailer is still onsite and Mr. Bellefleur does not have a CO.

M. Ellis asked if anyone objected to closing the Public Hearing and no one did.  

E. Standish motioned to close the Public Hearing.  E. Standish seconded the motion.  All in favor.  

Regular Meeting


PZC2010-3 Application for Modification to Special Permit & Final Site Development Plan to add in the future a 25X35 ~3 sided pole building at 49 Hancock Road (Map 38 Lot 20 Zone R80) Owner/Applicant: Town of Willington (Rcd. 3/16/10, ~65 day extension granted Dec. by 8/17/10).

S. Yorgensen said the applicant was waiting for an approval letter from DEP which they now have.  A discussion was held on the location of the proposed building.  

J. Sullivan motioned to approve the application with the condition that the as-built be updated.  P. Nevers seconded the motion.  

A discussion was held on asbestos based products and various items placed in the swap shed.  

The commission voted.  All in favor.  Motion carried.

PZC2010-19 Application to amend Subdivision Regulation Chapter VI section 3-i pertaining to underground propane storage tank Applicant: Northeast Oil & Propane, Inc (Rcd. 5/18/10, ~P.H. 6/15/10, ~Dec. by 8/17/10.)

M. Ellis motioned to approve the application with the following wording: “There shall be no underground tanks on any lot for storage of any petroleum product. (Not including underground propane tanks in subdivisions – underground tanks shall be located on the as-built and the Fire Marshall shall be notified of each location)” E. Standish seconded the motion.  

A discussion was held on transferring the wording to the new regulations.  A discussion was held on petroleum based products.  

The commission voted.  All in favor. Motion carried.

The commission asked staff to draft a motion for the next meeting.

PZC2010-16 ~Application for Special Permit to open restaurant at 11 Phelps Way (Map 30 Lot 14 Zone DC) Owner: C & S Willington LP Applicant: Luciano Conforto (Rcd. 5/4/10, P.H 6/1/10, continued to 6/15/10, ~Dec. by 8/17/10)

The applicant was not present and has not attended previous meetings regarding this application.  

A. Marco motioned to deny, without prejudice, the application for the following reasons: The Commission has not received enough information to make a positive finding.  We do not have an approval from the Health District.  The application as it stands is incomplete.  E. Standish seconded the motion.  All in favor.  

J. Poole arrived at 7:40.

M. Ellis motioned to approve the minutes of 6/15/10.  J. Sullivan seconded the motion.  All in favor.  

New Business

Request for release of Bond at Ruby Road (Map42 Lot 48) Owner/Applicant: Margaret Harrison & Lisa Harrison-Kenderdine

The applicant’s attorney asked that the request be tabled for this meeting.  Request was tabled.  

PZC2010-24 Application for Zone Change of 34.84 acres and Preliminary Site Plan approval from R-80 to RL located at 256 Ruby Road (bus lot Map 42 Lot 49B) & (behind School Bus Lot (Map 42 Lot 49) Owner/Applicant: Town of Willington (Rcd. 7/20/10, P.H. 8/17/10. Dec. within 65 days after close of P.H.)

Application was received 7/20/10.  Public Hearing scheduled for 8/17/10.

PZC2010-25 Application for Special Permit & Final Site Development Plan approval for material storage area at east side of Ruby Road behind school bus lot, 256 Ruby Road (Map 42 Lot 49) Owner/Applicant: Town of Willington (Rcd. 7/20/10, P.H. 8/17/10. Dec. within 65 days after close of P.H.)

Application received 7/20/10.  Public Hearing scheduled for 8/17/10.

Discussion
        Subdivision Regulations

S. Yorgensen said she spoke with Teri Haun about getting the draft by the end of July.  M. Ellis will follow up with Teri Haun.

Correspondence

1.  Notice from Coventry Planning and Zoning regarding a Zoning Regulation Amendment.

2.  Letter to Planning and Zoning from Grace and Richard Hirth expressing their concerns regarding the proposed Love’s Travel Stop.

3.  Letter from Gary Jones to Commission regarding Ruby Associates/site walk conducted.  

4.  Incident Report regarding a Petroleum spill at 327 Ruby Road.

Staff Report and Discussion

S. Yorgensen showed the Commission the proposed signage pictures from TA.  A discussion was held on reducing the square footage and total illumination.  S. Yorgensen will contact TA regarding this.  

J. Poole expressed his concern on the language regarding underground storage tanks and not specifying the maximum size allowed.  A discussion was held.  A discussion was held regarding the inspection of the tanks.
